Return Policy: At Daytona MIG we want you to be happy with our products. We are pleased to offer the following return policy: If you wish to return a product, notify Daytona MIG within 15 days of receipt of the order. Upon notification Daytona MIG will issue a return authorization number to be referenced in all correspondence concerning the return. The outside of the returned package must also bear this return number and all returns are to be sent freight or postage prepaid to Daytona Beach. Shipping charges are non-refundable. Goods returned for credit may be assessed a restocking charge which will be determined by Daytona MIG on a case by case basis. Daytona MIG shall not be required to accept return of any used, damaged, defaced or obsolete goods in any event. Goods damaged in transport: In the event of damage to goods received, please contact Daytona MIG by the following business day. Daytona MIG will make a good faith effort to assist the customer in resolving the matter with the freight carrier. However, in all cases, risk of loss or damage to goods in transit shall be borne by the customer. No Claims (price, shortage, or defective) approved unless advised in writing within 5 days after receipt of merchandise by customer. Returns must have return authorization number issued by Daytona MIG. To assure prompt issuance of credit, please refer to invoice number on which purchase was made. No returns will be accepted without authorization by Daytona MIG. Terms of Sale: Unless otherwise specified herein Daytona MIG standard prices in effect at the time of shipment will govern the sale of the products. All prices quoted are FOB South Daytona, FL. Terms of payment are Daytona MIG regular terms unless otherwise specifically quoted to the customer. If the customer fails to fulfill these terms or if Daytona MIG at any time has any doubt as t o the customer's financial responsibility Daytona MIG may decline to make further deliveries except against cash or satisfactory security as determined by Daytona MIG. A finance charge of 1-1/2% per month, which is an annual rate of 18%, will be assessed on all invoices not paid within Daytona MIG required terms. Credit balance: Customer agrees that any credit balances issued will be applied within one (1) year of its issuance. If not applied or requested within one (1) year, any remaining balance will be subject to cancellation and Daytona MIG shall have no further liability. Quotations: Quotations shall be valid for a period of 30 days after the date of issue unless otherwise specified within the quote. Limited Warranty: Daytona MIG warrants that its products be free of defects in workmanship or material. Should any failure to conform to this warranty appear within the time period applicable to the Daytona MIG products as indicated below, Daytona MIG shall, upon notification thereof and substantiation that the product has been stored, installed, operated, and maintained in accordance with Daytona MIG specifications and instructions, repair or replace, at Daytona MIG in its sole option, any components or parts of the product determined by Daytona MIG to be defective. This warranty shall not apply to any goods that have been altered or repaired, or that have been subject to misuse, negligence, or accident, including, without limitation, use and operation of the goods while any parts are loose broken, or damaged. In the event goods must be returned to Daytona MIG for service, they must be returned freight prepaid. If the goods are covered under the below stated warranty period and determined by Daytona MIG in its sole discretion to be defective, the goods will be returned to the customer freight prepaid by Daytona MIG in the best way it sees fit. If the customer does not return the defective goods to Daytona MIG within ninety (90) days after delivery of the goods to the customer in the case of damaged or initially defective goods any claim for breach of warranty shall be conclusively deemed to have been waived and Daytona MIG shall not be liable under this warranty. If the customer does not return goods which subsequently appear to be defective within ninety (90) days of notification to Daytona MIG of such defect, any claim for breach of warranty shall be conclusively deemed to have been waived and Daytona MIG shall not be liable under this warranty. The warranty periods for Daytona MIG products shall be as follows: Power supplies (MIG, TIG, Plasma) five (5) years on primary transformer of such machines and one (1) year on balance of internal parts ans service. Torches and leads- sixty (60) days. Replacement repair parts (exclusive of labor) sixty (60) days. Service to be provided by Daytona MIG in Florida and all dates are from delivery of goods to customer. Auto-darkening helmets - one (1) year or a period equivalent to that given by the manufacturer. Service on helmets to be provided by manufacturer. Any other products sold by Daytona MIG carry no warranty but will extend to you such warranties respecting such products as are permissible under the terms thereof. Exclusive Warranty: Except for the express warranty as described above, there are no warranties, including any implied warranties as merchantability or fitness for any particular purpose, which extend beyond the description of the products on the face hereof, no warranties or representations at any time made by any representative of the company shall be effective to vary or extend the above referenced express warranties or any other terms hereof. Limitation of Liability: In no event shall the company be liable for incidental, consequential or special damages resulting from or in any manner related to the products, their design, use, or any inability to use the same, including, without limitation, damages arising out of or in any manner relating the delivery of the products or any delay with respect to their delivery, it being understood that the sole and exclusive remedy with respect to defective products manufactured by it shall be the repair, correction or replacement thereof pursuant to the "warranty" provisions hereinabove contained. Should the products prove so defective, however, as to preclude the remedying of warranted defects by repair or replacement, the customer's sole and exclusive remedy shall be refund of the purchase price of the defective products involved upon the return of the products to Daytona MIG. Product suitability: Many states, localities and sporting organizations have codes and regulations governing sales, construction, installation, and/or use of products for certain purposes, which may vary from those in neighboring areas. While Daytona MIG attempts to assure that its products comply with such codes, it cannot guarantee compliance, and cannot be responsible for how the product is installed or used. Before purchase and use of a product, please review the product application, and national and local codes and regulations, to be sure that the product, installation and use comply with them. Additionally, Daytona MIG shall have no responsibility whatsoever for compliance with such laws, etc. by products manufactured by others. Force Majeure: Daytona MIG shall not be liable for any delay in or impairment of performance resulting in whole or in part from Acts of God, labor disruptions, shortages, inability to procure product, supplies or raw materials, severe weather conditions, or any other circumstances or cause beyond the control of Daytona MIG in the conduct of its business. Infringement: Daytona MIG makes no representation or warranty that the delivery or subsequent use of the products ordered shall be free of the claim of any third party by way of infringement. Changes in detail of design: Daytona MIG and or its suppliers shall be entitled to make any and all changes in details of design, fabrication or arrangement of the products as the company in its sole discretion determines will constitute an improvement upon the products or any specifications of designs previously furnished to the buyer. Technical Advice: Any technical advice provided by Daytona MIG before or after delivery in respect to the installation or use of the products represents Daytona MIGs best judgment under the circumstances but Daytona MIG assumes no liability therefor. Venue: Any action arising out of or relating to these terms may be brought in any federal or state court in Florida having jurisdiction of the subject matter, and customer consents to the court having personal jurisdiction over customer.
